By accessing the Website, creating an account, placing an order, or purchasing a product from YGEIA, you acknowledge that you have read, understood, and agreed to these Terms and all policies referenced herein.

If you do not agree with these Terms, please do not use the Website or place an order.

1. ABOUT YGEIA

YGEIA is a wellness and lifestyle brand offering thoughtfully designed products, including pendants, amulets, and related items.

Our main brand website is ygeia.co, while purchases and transactions may be processed through our Shopify-powered online store at shop.ygeia.co.

Our legal entity information and governing jurisdiction may be updated following completion of our U.S. business registration.

2. ELIGIBILITY & USE OF THE WEBSITE

By using this Website or placing an order, you represent that you have the legal capacity to enter into a binding agreement under the laws applicable to you.

You agree to use the Website only for lawful purposes and in accordance with these Terms.

You may not use the Website, its products, content, or services for fraudulent, unlawful, abusive, or unauthorized purposes.

3. PRODUCT INFORMATION

YGEIA makes reasonable efforts to present product descriptions, photographs, dimensions, materials, colors, finishes, and other product information as accurately as possible.

However, product appearance may vary slightly due to photography, lighting, screen settings, manufacturing processes, natural materials, craftsmanship, or other production characteristics.

Such reasonable variations do not necessarily constitute a product defect.

Customers are responsible for reviewing all available product information before completing a purchase.

5. PRICING & AVAILABILITY

All prices are displayed in the currency indicated on the Website.

Prices, product availability, promotions, specifications, and product offerings may be changed at any time without prior notice, subject to applicable law.

Placing an item in your cart does not reserve the product.

An order is subject to availability and acceptance by YGEIA.

In the event of a pricing, description, technical, inventory, or other material error, YGEIA reserves the right to correct the error and, where legally permitted, cancel or adjust an affected order.

6. ORDERS & ORDER ACCEPTANCE

Submitting an order does not automatically constitute acceptance by YGEIA.

YGEIA reserves the right, where reasonably necessary and permitted by law, to refuse, cancel, limit, or review an order, including in cases involving:

  • suspected fraud or unauthorized payment;

  • incorrect or incomplete customer information;

  • pricing or inventory errors;

  • unusual purchasing activity;

  • suspected resale or commercial misuse;

  • violation of these Terms; or

  • circumstances that prevent YGEIA from reasonably fulfilling the order.

If payment has already been captured for an order that YGEIA subsequently cancels, the applicable amount will be reversed or refunded where required.

7. PAYMENT

Customers must provide accurate, complete, and current billing and payment information.

Payment may be processed by Shopify, payment gateways, financial institutions, or other authorized third-party payment providers.

YGEIA may conduct reasonable payment verification or fraud-prevention checks before fulfilling an order.

Where reasonably necessary to protect against fraud or unauthorized transactions, additional verification may be requested before an order is processed.

8. FINAL SALE — NO RETURNS, REFUNDS OR EXCHANGES

Unless otherwise required by applicable law, all YGEIA purchases are final sale.

YGEIA does not accept returns, refunds, or exchanges for reasons including, but not limited to:

  • change of mind;

  • personal preference;

  • ordering the wrong product;

  • dissatisfaction with reasonable variations in color, appearance, texture, or finish;

  • failure to review the product information before purchase; or

  • damage occurring after delivery due to use, handling, storage, accident, misuse, or normal wear.

Exception — Item Received Damaged or Defective

If an item arrives damaged or defective, the customer must contact YGEIA within 48 hours of the carrier's recorded delivery time.

The customer may be required to provide:

  • Order ID;

  • photographs of the item;

  • photographs of the packaging and shipping label; and

  • clear unboxing video or other reasonable supporting evidence.

Claims submitted after the applicable claim period, claims without sufficient supporting evidence, or damage occurring after delivery may not qualify for resolution, except where otherwise required by applicable law.

Approved claims will be reviewed and resolved by YGEIA in accordance with the circumstances of the claim and applicable law.

9. SHIPPING & DELIVERY

Shipping estimates are provided for convenience and are not guaranteed delivery dates unless expressly stated otherwise.

Delivery may be affected by customs processing, courier operations, weather, public holidays, remote-area conditions, international transportation, or other circumstances outside YGEIA's reasonable control.

Customers are responsible for providing complete and accurate shipping information.

10. CUSTOMS, DUTIES & IMPORT TAXES

International orders may be subject to customs duties, import taxes, VAT, brokerage fees, handling charges, or other governmental charges imposed by the destination country.

Unless expressly stated otherwise at checkout, these charges are the responsibility of the customer and are not included in the product or shipping price.

YGEIA does not control customs authorities or determine the amount of taxes or duties imposed by a destination country.

11. PROMOTIONS & DISCOUNT CODES

Promotions, discount codes, special offers, crowdfunding-related offers, pre-launch offers, or other incentives may be subject to separate terms and eligibility requirements.

Unless expressly stated otherwise, promotional offers may not be combined or stacked.

YGEIA reserves the right to modify, suspend, reject, or cancel a promotion in cases of error, misuse, fraud, or violation of the applicable promotional terms, subject to applicable law.

12. INTELLECTUAL PROPERTY

All content appearing on YGEIA websites, including trademarks, trade names, logos, product names, product designs, photographs, videos, graphics, illustrations, text, packaging concepts, website designs, and other creative materials, is owned by or licensed to YGEIA unless otherwise stated.

Such content may not be copied, reproduced, modified, distributed, commercially exploited, or used without prior authorization from YGEIA or the applicable rights holder.

13. PROHIBITED USE

You may not use the Website to:

  • engage in fraudulent or unlawful activity;

  • interfere with Website security or functionality;

  • attempt unauthorized access to systems or accounts;

  • submit false or misleading information;

  • misuse promotions or payment systems;

  • reproduce or commercially exploit YGEIA intellectual property without authorization; or

  • engage in activity that violates applicable law or these Terms.

YGEIA may restrict access or cancel affected transactions where reasonably necessary in response to prohibited activity.

The Website may use or link to third-party platforms and services, including Shopify, payment processors, shipping carriers, analytics services, social platforms, and other technology providers.

YGEIA is not responsible for the independent operation, availability, content, privacy practices, or policies of third-party services.

Your use of third-party services may also be subject to their respective terms and policies.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, YGEIA will not be liable for indirect, incidental, special, consequential, or similar damages arising from the use of the Website or YGEIA products.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

16. FORCE MAJEURE

YGEIA will not be responsible for delays or failure to perform caused by circumstances beyond its reasonable control, including natural disasters, severe weather, transportation disruption, customs delays, governmental actions, labor disputes, carrier disruptions, infrastructure failures, or other force majeure events.

17. FRAUD, ABUSE & CHARGEBACKS

Customers agree to contact YGEIA regarding legitimate order or product concerns before initiating a payment dispute where reasonably possible.

YGEIA reserves the right to provide relevant transaction records, order information, shipping records, tracking information, customer communications, and other supporting evidence to payment processors, financial institutions, or dispute-resolution providers when responding to a chargeback or payment dispute.

Fraudulent claims, unauthorized misuse of payment systems, or deliberate abuse of YGEIA policies may result in order cancellation or restriction from future purchases where permitted by law.

18. PRIVACY

Personal information collected through YGEIA websites and transactions will be handled in accordance with our Privacy Policy and applicable privacy laws.

Certain information may also be processed by Shopify and other service providers necessary to operate the online store, process payments, fulfill orders, prevent fraud, and provide related services.

19. GOVERNING LAW & JURISDICTION

YGEIA is currently completing its U.S. legal entity registration.

The applicable governing law, jurisdiction, and dispute-resolution provisions will be identified and incorporated into these Terms following completion of the relevant registration.

Nothing in these Terms is intended to remove mandatory consumer rights that cannot legally be waived under applicable law.

20. CHANGES TO THESE TERMS

YGEIA may update these Terms from time to time to reflect changes to our products, services, operations, legal requirements, or business practices.

The most current version will be published on the Website together with the applicable effective or updated date.

Continued use of the Website following an update constitutes acceptance of the revised Terms to the extent permitted by applicable law.
